The Princess Bride Sketch Contest OFFICIAL RULES NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. THE PRINCESS BRIDE SKETCH CONTEST (THE “CONTEST”) IS A CONTEST OF SKILL OPEN ONLY TO GIRLS WHO AT THE TIME OF ENTRY ARE 9-16 YEARS OLD AND LEGAL RESIDENTS OF AND LOCATED IN ANY OF THE 50 UNITED STATES (EXCLUDING PUERTO RICO, GUAM, THE U.S. VIRGIN ISLANDS, ALL OTHER TERRITORIES AND POSSESSIONS OF THE UNITED STATES, AND WHERE OTHERWISE PROHIBITED BY LAW) (THE “TERRITORY”). By entering this Contest, you are agreeing to comply with and be bound by these Official Rules, the Girl Gamer Squad web site (the “Site”) Privacy Policy (the “Privacy Policy”) and the Site Terms of Use (the “Terms of Use”) (collectively, the “Site Documents”). Parents, by giving your child permission to enter this Contest, you are also agreeing to be bound by and to be responsible for your child’s compliance with, the Site Documents. The Privacy Policy and Terms of Use can be accessed here: WHO MAY ENTER. No purchase necessary. Void where prohibited, and subject to federal and state laws. The Contest is a contest of skill open only to girls who at the time of entry are ages 9-16 and are legal residents of and located in, the Territory. The Contest is not open to employees and the immediate family members of Worldwide Biggies, Inc. and Yovia, LLC (collectively, the “Sponsors”) nor any of the Sponsors’ respective directors, officers, limited liability company members, employees, nor agents, nor any individuals engaged in the development or operation of this Contest. WHEN TO ENTER. The Contest commences at 12:01 a.m. Eastern Time (“E.T.”) on May 1, 2008 and ends at 11:59 p.m. E.T. on June 17, 2008 (“Contest Period”). Online entries must be received during the Contest Period. Mailed-in entries must be postmarked no earlier than the first day of the Contest Period and must be received no later than June 20, 2008 THE PRIZE. There is one (1) prize for the winning entry, consisting your name being posted on the official Princess Bride Game Site. The prize will be provided by Yovia, LLC. The odds of winning will depend on the total number of eligible entries received. Prizes are awarded AS IS AND WITHOUT WARRANTY OF ANY KIND by Sponsors, express or implied, without limitation. The winner agrees to look solely to the manufacturer of the prize for any warranty. The prize is non transferable and cannot be returned for cash. HOW TO WIN. As an eligible entrant and in accordance with these Official Rules, submit a sketch drawn by you that is judged to be the most creative image of one of the Princess Bride characters or background images. HOW TO ENTER. You may enter online or via U.S. mail. 1. (a) Enter Information Online. Discuss the Contest with your parent or guardian (your “Parent”) and if they let you enter, then enter your first name, email address and Parent’s email address online at http://gamersquad.princessbridegame.com/Site/form.html during the Contest Period, and attach your black and white or color sketch to the email in either jpeg or pdf. Format. Please ask your Parent for help attaching your sketch to your email, if you need it. (b) Enter via U.S. Mail. Discuss the Contest with your Parent and if they let you enter, send your first name, email address, and Parent’s email address in a package with your sketch by first class mail, postage prepaid, to Yovia, LLC, at 1909 N. 3rd Street, Jacksonville Beach, Florida 32250. If you choose this method of entry, your sketch must be postmarked no earlier than the first day of the Contest Period and must be received by the Sponsors no later than June 17, 2008 .We must have your first name and Parent’s email address for a valid entry. Please ask your parents for help addressing your envelope and including your sketch (but parents should not help create the sketch). Do not send any original art. We just need a copy of your sketch (you decide whether you want to send us a sketch in black and white or color). 2. Parent Opt Out. Your Parent will be sent an email notification upon your submission of the online information or our receipt of the mail entry. This notice will confirm that you have entered information to enter into the Contest and will provide your Parent with the option to opt out of your participation in the Contest within a specified time period. If your Parent opts out and informs us that he/she does not want you to participate, any information you have submitted in connection with the Contest will be deleted or destroyed, including your sketch. JUDGING AND NOTIFICATION OF WINNERS. Submitted sketches will be judged by a qualified individual selected by Yovia, LLC who is neither an employee nor affiliated in any way with the Sponsors (hereinafter, the “Judge”). The judging is scheduled to occur during the following period _June 17, 2008 through June 20, 2008 which dates are subject to change. The Judge will select the one (1) winner from all eligible submitted sketches who receives the highest combined score based on the following criteria: (a) originality; (b) creativity In the unlikely event of a tie, the winner will be determined by the highest score in originality The Judge’s decision is final on all matters relating to the Contest. Yovia, LLC reserves the right to post the entries on the Site. Sketches submitted to the Contest must be the entrant’s own original design and creation (other than to the extent inspired by or based on the Princess Bride characters themselves), executed solely by the entrant, and may not have been entered in any other contest or won any other award. Sketches submitted may not have been published previously and may not be subject to any rights of any other person (other than to the extent inspired by or based on the Princess Bride characters themselves). They also must not be offensive, as determined by the Judge in his or her sole discretion. PRIVACY. The collection and use of personal information will be in accordance with the Privacy Policy as posted at GENERAL. Entrants not complying with these requirements will be subject to disqualification. In consideration for the right to participate in the Contest and be considered for the prize, entrant unconditionally assigns and transfers to Yovia, LLC all right, title and interest, including copyright, which it now has or may in the future have, in the entries, and waives any moral rights therein. Yovia, LLC shall have the right to use, copy, assign, license, edit, modify, make derivative works of, and/or dispose of the sketch entries as it sees fit without the approval of entrant. ENTRIES INCLUDING SKETCH ENTRIES BECOME THE PROPERTY OF YOVIA, LLC AND WILL NOT BE RETURNED. By participating, you agree to abide by and be bound by these Official Rules and the decisions of the Sponsors. Sponsors are not responsible for lost, late, delayed, stolen, misdirected, incomplete, mutilated, deleted or ineligible entries, entries with insufficient postage, nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Yovia, LLC on account of technical problems or traffic congestion on the Internet or at any website, or by human error or intervention which may occur, or any combination thereof. All Internet access and use charges are the responsibility of the entrant. Any mass entries or entries generated by a script, macro or automated devices will be disqualified. Sponsors are not responsible for any injury or damage to entrant’s or any other person’s computer, modem, or other electronic device related to or resulting from entering, or participating in, receiving, or downloading any materials in connection with, the Contest, or any other liability or damage of any kind related to this Contest, to the extent allowed by law. No substitution or transfer of prize or cash equivalent is permitted except by Sponsors and Sponsors reserve the right to substitute the prize with prizes of equal or greater values. Taxes, including federal, state, and local, on the prize, if any, are the responsibility of the individual winner. If the Contest is not capable of running as planned, due to, for example, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right to terminate, modify or suspend the Contest in whole or in part, and reserve the right to conduct the remaining Contest from registered eligible entries correctly submitted prior to the termination of the Contest. Persons found tampering with or abusing any aspect of this Contest, as solely determined by Sponsors, will be disqualified. If disqualified for any of the above abuses, Sponsors reserve the right to terminate the entrant’s eligibility to participate in the Contest. By entering the Contest, to the fullest extent permitted by law: (a) entrants agree to indemnify and hold harmless Sponsors and their respective directors, officers, limited liability company members, employees and agents (collectively the “Released Parties”) from and against any and all claims, injury, loss or liability any of the Released Parties incur due to entrant’s participation in the Contest or use of entrant’s entry; and entrants hereby waive all claims against any of the Released Parties that entrant or anyone claiming through entrant may have arising out of entrant’s participation in the Contest or use of entrant’s entry. Each entrant agrees that, to the fullest extent permitted by law (1) any and all disputes, claims and causes of action arising in connection with this Contest, or any prizes awarded, shall be resolved individually and without combining the individual’s claims with the claims of others; (2) any judicial proceeding shall take place in the state or federal courts within the State of Florida, County of Duval, United States; and (3) any and all claims, judgments, or awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys fees or other damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and rights of the entrant in connection with this Contest shall be governed by, and construed in accordance with laws of the State of Florida, without giving effect to its principles of conflicts of laws. WINNER LIST. For the name of the winner (first name and first initial of last name), send a self-addressed, stamped envelope to: Yovia, LLC PUBLICITY RELEASE. By entering the Contest, you are granting permission for Yovia, LLC to post on the Site your first name, first initial of last name, city and state of residence, and your sketch submission.
